1. Who we are

us.iscent.com (the "Store") is operated by ISCENT Inc., a Delaware corporation ("ISCENT", "we", "us" or "our"). You can reach us at info@iscent.com or (608) 400-0012.

2. Agreeing to these terms

By using the Store or placing an order, you agree to these Terms of Service, our Shipping Policy and our Refund Policy. Our Privacy Policy explains how we collect and use your personal information. If you don't agree, please don't use the Store. You must be at least the age of majority where you live to place an order.

3. Products

We make every effort to describe and show our products accurately, but colors and finishes may look different on your screen. Products are subject to availability, and we may change or discontinue products at any time.

4. Prices and payment

Prices are shown and charged in US dollars. Shipping and any applicable sales tax are added at checkout. Prices can change without notice, but the price you pay is the one shown when you place your order. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full. Payments are processed securely by our payment providers; we don't store your full card details.

5. Orders

Your order confirmation email confirms that we've received your order. We may decline or cancel an order, for example if a product is unavailable, a price or description was wrong, or we suspect fraud. If we cancel an order you've paid for, we'll refund you in full within 7 days.

6. Shipping, returns and refunds

Shipping is covered by our Shipping Policy, and returns and refunds by our Refund Policy. Risk of loss passes to you when your order is delivered.

7. Limited warranty for Ensō diffusers

Our Ensō and Ensō Mini diffusers come with a 1-year limited warranty. Its full terms are on our Warranty page.

8. Using our products safely

Use our diffusers and fragrance oils only as directed. Fragrance oils are for use in a diffuser only: don't swallow them or apply them to skin, and keep them out of reach of children and pets.

9. Intellectual property

The ISCENT name, logos, product names, images, text and other content on the Store belong to ISCENT or its licensors and are protected by law. You may not copy or use them without our written permission, except to use the Store for its intended purpose.

10. Reviews and submissions

If you submit a review, photo or other content, you confirm it's your own and reflects your honest experience, and you give us a non-exclusive, royalty-free license to use, reproduce and display it in connection with ISCENT. You keep ownership of your content. We don't remove or hide reviews because they're negative. We may remove or decline to show content that includes someone's personal or confidential information; is unlawful, defamatory, harassing, abusive, obscene or sexually explicit; is discriminatory; is clearly false or misleading; or is unrelated to our products.

11. Acceptable use

You agree not to misuse the Store, including by attempting to interfere with its operation, access it by automated means that place an unreasonable load on it, or use it for any unlawful purpose.

12. Third-party services

The Store runs on Shopify, and payments are handled by third-party payment providers. We may link to other websites. We're not responsible for third-party websites or services, which have their own terms.

13. Disclaimers

The Store (our website) is provided "as is" and "as available". This section is about the website only, not the products you buy from us. Our diffusers come with the limited warranty in section 7, which also explains how long implied warranties on them last. We don't limit any implied warranty on our fragrance oils.

14. Limitation of liability

If something goes wrong with a product you bought from us, your remedies are the ones in our Refund Policy, our limited warranty for diffusers, and the rights the law gives you. We aren't liable for losses that weren't reasonably foreseeable when you placed your order. For any other loss relating to a product, our liability is limited to the price you paid for it.

Nothing in these terms limits our liability for death, personal injury or damage to property caused by a product we sold you or by our negligence, or for fraud or willful misconduct. Nothing in these terms limits any right you have under the consumer protection or product liability laws of the state where you live. If you live in New Jersey, nothing in sections 13 or 14 limits any right you have under the New Jersey Consumer Fraud Act, the New Jersey Products Liability Act or the New Jersey Punitive Damages Act.

15. Governing law and where to bring a claim

These terms are governed by the laws of the State of Delaware. This choice of law doesn't take away the protection of the consumer laws of the state where you live. You can bring a claim against us in a court that has jurisdiction in the state where you live, including small claims court, or in Delaware.

16. Changes to these terms

We may update these terms from time to time. The version posted on the Store when you place an order applies to that order.

17. General

If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision isn't a waiver of it. These terms, together with our Shipping Policy, our Refund Policy and the limited warranty for diffusers, are the entire agreement between you and ISCENT about your use of the Store.
